Community Terms and Conditions – Allround The Agency

Scope: This document applies to all communities within the Allround The Agency online environment, regardless of the platform on which they are offered. Thank you for choosing Allround The Agency. We believe in clear, fair agreements. In this document, we explain in plain language what you can expect from our community – and what we ask of you – so that together we can create a safe and inspiring environment.

Article 1 – Who are we?

We manage one or more communities within our online learning environment, aimed at supporting (budding) freelancers and entrepreneurs.
Article 2 – What is the community?
2.1 The community is an online environment (consisting of various WhatsApp groups) where, as a participant, you can meet other participants, share experiences, ask questions and exchange knowledge with us and with one another. We offer two ‘open’ WhatsApp groups which are free of charge and to which you can request access without using our paid services. A short admission test applies, and the same rules of conduct apply as for the separate WhatsApp group linked to the paid ‘Jobboard access + Guidance’ membership.
Articles 2.2 and 3 of these terms and conditions relate exclusively to this Jobboard group. All other articles mentioned in these terms and conditions apply to all WhatsApp groups facilitated by Allround The Agency.
2.2 Access to the community may be linked to: What applies in your situation is stated in your registration or in the information relating to the relevant programme or online course.
• your participation in an online programme; or
• a (stand-alone community) membership within the online environment.
2.3 The community is not a substitute for medical, psychological, legal or financial advice. Everything shared is intended for inspiration and information; you remain solely responsible for your own choices at all times.
Article 3 – Access and duration of participation
3.1 You will gain access to the Jobboard WhatsApp community as soon as:
-
you have registered in accordance with our instructions; and
-
you have fulfilled (where applicable) your payment obligations for the linked programme/online course or community membership.
3.2 Your participation and access are personal. You must not share your account or login details with others.
3.3 The duration of your access to the Jobboard WhatsApp community is:
-
for as long as the online programme runs, if the community is linked to it; or
-
for as long as your separate community membership runs, in accordance with the relevant terms and conditions.
3.4 We may (temporarily) restrict, suspend or terminate your access if you repeatedly or seriously breach these community terms or the Code of Conduct. Where possible, we will first contact you to discuss the situation.
Article 4 – Behaviour within the community
4.1 We want the community to be a safe, respectful and constructive space. Therefore, in addition to these Community Terms, the Code of Conduct – Community Around The Agency also applies. By participating, you agree to this Code of Conduct.
4.2 Essentially, this means that you must:

treat others with respect, even if you disagree with them;
-
not post discriminatory, offensive, threatening or hateful comments;

not send spam and not use the community purely as an advertising channel, unless we explicitly allow this;

not share others’ confidential information outside the community without their consent.
4.3 In the case of minor breaches, we may first contact you and ask you to amend or remove your post. In the case of repeated or serious breaches, we may remove posts and (temporarily) remove you from the community.
Article 5 – Your content in the community
5.1 Everything you post in the community (such as messages, comments, images and files) is referred to as ‘user content’.
5.2 You retain ownership of your user content. By posting:
-
you grant us a non-exclusive licence to display, store and process your content within
-
the online learning environment and the community;
-
you warrant that your content does not infringe any third-party rights and does not
-
contravene the law or these terms and conditions;
5.3 Only post content:
-
which you have created yourself, or
-
for which you have permission, and
-
which is appropriate to the purpose and atmosphere of the community.
5.4 Do not share sensitive personal information about others without their express consent, and think carefully about what personal information you yourself wish to share.
Article 6 – Use of your contributions outside the community
6.1 Occasionally, we may wish to share a notable contribution, quote or outcome from the community (such as a testimonial) outside the community, for example on our website, social media or in newsletters. We will only do so:
-
if we clearly ask you for permission in advance; and
-
if you give us your explicit consent, preferably via the Consent Form for Publication of Community Content.
6.2 You can specify whether we should use your full name, just your first name, or no name at all.
6.3 You may withdraw your consent at a later date. Any use that has already taken place remains lawful, but we will do our best to stop or adjust any new use.
Article 7 – Moderation and reports
7.1 We moderate the community to keep it safe, respectful and valuable. This means that we:
-
may review posts and comments;
-
may hide, edit or remove content that contravenes the law or our rules;

may address, warn or – in extreme cases – (temporarily) remove participants from the community.
7.2 If you see content that you believe is unacceptable (for example, discriminatory, threatening, misleading or infringing), please report it via our Reporting procedure – Community Allround The Agency.
7.3 We take reports seriously, assess them carefully and take action where necessary. Where possible, we will let you know what action we have taken in response to your report.
Article 8 – Liability
8.1 The community is a space where participants post messages and share experiences themselves. We are not responsible for the content posted by other participants.
8.2 We do our best to provide a safe environment, but we cannot guarantee that all content complies with all rules at all times.
8.3 You remain responsible for any decisions you make based on information from the community. The community is not a substitute for professional (medical, psychological, legal
or financial) help.
8.4 To the extent permitted by law, our total liability for any loss or damage arising in connection with the community is limited to the amount you have paid to us for the relevant course, online programme or community membership. We are not liable for indirect loss, consequential loss or loss of profit, except in cases of wilful misconduct or gross negligence on our part.
Article 9 – Personal Data and Privacy
9.1 Within the community, we process personal data, such as your name, profile details and the content of your messages.
9.2 We handle this data with care. In our privacy policy, we explain:

what data we process;
-
for what purposes we do so;
-
how long we retain it;
-
which service providers we work with;
-
what rights you have (such as the right to access, rectify and erase data).
9.3 By using the community, you agree to Allround The Agency’s privacy statement. You can find it via the link in the footer of our website www.allroundtheagency.com.
Article 10 – Changes to the community and terms and conditions
10.1 We may amend, expand or terminate the structure or functionalities of the community if there is a valid reason to do so (for example, new technology, changes in legislation or content-related decisions regarding our services).
10.2 We may also amend these community terms and conditions from time to time. In the event of significant changes, we will inform you by email or via a message within the community.
10.3 The new version applies:
-
immediately to new members; and
-
to existing members from the announced effective date.
If you continue to use the community after that date, you agree to the amended terms and conditions.
Article 11 – Governing law and disputes
11.1 These community terms and conditions are governed by Dutch law.
11.2 Should a disagreement arise regarding your participation in the community, we will first seek a solution together.
11.3 If this proves unsuccessful, the dispute – unless mandatory law provides otherwise – will be submitted to the competent court in the judicial district where Allround The Agency is
based.
These Community Terms, the Code of Conduct, the reporting procedure, the moderation protocol, the consent form for publication and the privacy statement together form the framework for your participation in the community within our online environment.
